In 2002 the San Diego City Council had a legal obligation to fund the city's pension system. The City Council did not want to put money into the pension system because they wanted to use the money for other purposes. The Pension Board had a fiduciary duty to ensure that the pension was funded. City Council avoided making the necessary payment to the pension system by paying off the Pension Board with unfunded benefits.

Due to a court ordered release of documents by the Pension Board, the evidence came out last week. As City Attorney Mike Aguirre has alleged, certain City Council members and union leaders conspired with the pension board to cause the pension board to breach its fiduciary duty to the pension system by accepting a payoff instead of ensuring the proper funding to the pension system.

Now, the City Attorney is preparing the next legal step to set aside these illegal benefits. The City Council is trying to prevent the City Attorney from taking the legal steps necessary to set aside the illegal benefits by hiring yet another outside lawyer.

Deputy Mayor Toni Atkins has called a special city council meeting for Tuesday, October 11 at 2pm. The alleged purpose is for an out-of -town lawyer to present his views on the roles of the City Attorney, City Council and City Manager.

In 1931 San Diego voters approved a City Charter that ensured an independent elected City Attorney as described below:

"The City Attorney is to be elected by the people. This is a guarantee that the legal head of the government will be able to fearlessly protect interests of all San Diego and not merely be an attorney appointed to carry out wishes of council or manager."

Please come and support Mike on Tuesday so that City Council will see that the public supports Aguirre in the independent role of protecting the public's interest. Let City Council know that the City Attorney speaks for the people of San Diego. Mike Aguirre speaks for us.
